Meerbusch, 10. January 2024.
After intensive discussions and negotiations, an important step was taken in the self-administration process of Kautex Maschinenbau GmbH to secure the future of the company: The management – supported by the authorized lawyer Olaf Seidel from the national restructuring and insolvency law firm AndresPartner – has successfully transferred all the essential assets as well as the entire business operations of the specialized mechanical engineering company from Bonn to the German subsidiary of a Chinese investor.
The Bonn location, where the company has its headquarters and offices and develops and assembles the majority of its machines, which are primarily used to produce plastic containers, will continue to operate fully under the new management. As a result of the transaction, a large proportion of the jobs will be retained – a crucial milestone for a stable future for Kautex Maschinenbau GmbH and its workforce. This not only represents a significant and positive development in economically challenging times, but is above all a strong commitment to the location, the regional economy and the 155 transferred employees.
“We wish the company and its employees much success and all the best for the future. With the successful completion of the restructuring and the transferring restructuring, the course has been set,” says specialist lawyer for insolvency and restructuring law Olaf Seidel, who and his team were available to Kautex throughout the entire process and implemented essential restructuring measures in the company.
“With the transfer of business operations now taking place, the process has reached a quick and successful conclusion, which sets the course for a positive future for the company. The fact that this was possible in such a short time underlines the effectiveness of the self-administration procedure as an instrument for restructuring and maintaining companies,” comments Dr. Mark Boddenberg, specialist lawyer for insolvency and restructuring law as well as law firm partner, on the rapid progress and result of the proceedings. Michael Schütte, business lawyer, LL.M., adds: “The decisive factor for the rapid agreement on the sale of the business was the constructive cooperation of all those involved. Our thanks especially go to the self-administration team around lawyer Olaf Seidel for the speedy implementation.”
Background:
In August 2023, Kautex Maschinenbau GmbH filed an application for insolvency proceedings under self-administration with the responsible district court in Bonn. The self-administration procedure was opened on November 1, 2023. In order to cope with the complexity and legal challenges of the restructuring process, the company was supported by lawyer Olaf Seidel from the national law firm AndresPartner. Attorney Dr. Mark Boddenberg from the ECKERT law firm was appointed as administrator by the Bonn District Court and, together with ECKERT partner Michael Schütte (LL.M.), comprehensively accompanied the proceedings and the transfer process. The international investor process was led by the consulting company starkpartners consulting GmbH from Meerbusch. Thanks to the international presence of starkpartners in Singapore and Shanghai, it was possible to address numerous Asian investors and convince them of the possibilities of KAUTEX.
